Wow, What An Illegal Immigrant Hating Law!!

I feel compelled to share with you the actual text of this illegal immigrant hating law brought to my attention recently(h/t to HARP for providing this). I think you will be surprised when you read the extent of it. Just for fun, I am taking out the name of the state that crafted, this fascistic, police state engendering, xenophobic law (this is snark for those who may not know I can be a little sarcastic sometimes). I'll have the link and answer at the bottom. All sections in Bold are my doing.

Okay, here goes:
Section 834b. (a) Every law enforcement agency in_________ shall fully cooperate with the United States Immigration and Naturalization Service regarding any person who is arrested if he or she is suspected of being present in the United States in violation of federal immigration laws.

(b) With respect to any such person who is arrested, and suspected of being present in the United States in violation of federal immigration laws, every law enforcement agency shall do the following:

(1) Attempt to verify the legal status of such person as a citizen of the United States, an alien lawfully admitted as a permanent resident, an alien lawfully admitted for a temporary period of time or as an alien who is present in the United States in violation of immigration laws. The verification process may include, but shall not be limited to, questioning the person regarding his or her date and place of birth, and entry into the United States, and demanding documentation to indicate his or her legal status.

(2) Notify the person of his or her apparent status as an alien who is present in the United States in violation of federal immigration laws and inform him or her that, apart from any criminal justice proceedings, he or she must either obtain legal status or leave the United States.

(3) Notify the Attorney General of __________ and the United States Immigration and Naturalization Service of the apparent illegal status and provide any additional information that may be requested by any other public entity.

(c) Any legislative, administrative, or other action by a city, county, or other legally authorized local governmental entity with jurisdictional boundaries, or by a law enforcement agency, to prevent or limit the cooperation required by subdivision (a) is expressly prohibited.

"Demanding Documentation"?? What? How dare they demand substantiating documentation of someone's legal status. That's an outrage! Ahem.

You may be thinking this MUST be Arizona with this strong language regarding questioning suspected illegal immigrants given the levels of protest. I mean, yikes, that's some pretty strong language there in that entire section. They ain't messing around, that's for sure.

But what really struck me was the threat in #3-C regarding the prohibition against limiting or not cooperating with this law. Why? Because that would include the cities of Los Angeles and San Francisco, to name just two, which have voted to boycott Arizona over their very similar law. This is California's law on Illegal Immigrants.

Yep. So, when Obama, the President, dismisses out of hand a law that is extremely close to California's own law, that says something. Perhaps Obama can't be expected to know about California's law. But the freaking governor of the state should know about it, especially being a LEGAL immigrant himself. That makes Schwarzenegger's comment regarding Arizona even more surprising:
"I was also to go and give a commencement speech in Arizona, but with my accent I was worried they were going to deport me back to Austria," said Schwarzenegger.

The governor has said he's strongly opposed to the Arizona law. He says the attempt to control illegal immigration will create a "mess.

So, is he admitting that he is failing to follow the laws of his own state, and the Federal Government? Kinda seems that way to me.

Perhaps, instead of Obama criticizing Arizona, he should take a look at why the current federal law is not being upheld. Maybe he could ask if these cities and states who refuse to uphold this law are willing to forgive and all federal tax dollars - OUR dollars - because they are in violation of federal law. Yeah, right. I know, that will happen about the same time our unicorns and Obama cash show up, as my buddy, SFIndie, is wont to say.

I could be wrong, but I was pretty sure that all of these elected officials were required to take oaths of office pledging to uphold the laws and Constitution. Did some of these laws become optional at some point? Sure seems that way since entire cities are willing to take stands saying they REFUSE to uphold laws on the books in their own state. And if they refuse to follow federal and state laws, why should anyone follow what THEY say?

In the meantime, maybe these folks in CA can get off their high horses about Arizona, and maybe take a little look see at their own laws. Just a suggestion. Especially since Arizona is NOT going to take this lying down:

Moreover, this travel thing goes both ways, too. Oh, yes. Arizona residents are basically saying, "You can bite us" to San Diego:
Would-be tourists have notified the San Diego Convention and Visitors Bureau and some hotels that they are canceling their scheduled travel to the coastal vacation destination, according to the San Diego Union-Tribune.

I believe this is known as, "Screw me? Screw YOU screw me!" And don't think this isn't affecting San Diego:
That has tourism officials urging Arizonans to consider the resolutions as merely symbolic and local politics at work.

"We're in a very tough environment already because of everything else going on, and we don't need another negative impact to our industry," ConVis President Joe Terzi told the Union-Tribune. "This affects all the hardworking men and women who count on tourism for their livelihoods, so we’re saying, don't do something that hurts their livelihoods."

"I've been approached by a number of hotels who are very concerned because they’ve received cancelations from Arizona guests," Namara Mercer, executive director of the county Hotel-Motel Association, told the newspaper.

Roughly 2 million Arizonans visit San Diego each year but the recession has taken a toll on the hotel industry that was hoping for a comeback this year. Hotels are offering deep discounts to fill up their undersold rooms while the tourism board spends $7 million this spring and summer season to promote travel to the area.

Imagine that. There are actually consequences to the actions taken by these city councils, and Arizonans have no reason to see them as "symbolic."

Add these kneejerk, politically motivated decisions to our elected officials deciding they do not have to follow state or federal laws they decide they don't like. Can you imagine what would happen if we decide there are laws we just areen't going to bother following, and take a step further, demand others not follow, too? Oh, I know - whaddya say we try doing that with our taxes and see how far we get? Yeah, I know - not very far.

Maybe the Governor of Arizona needs to put her law down side by side California's law, and have a little chat with her fellow governor. Let him know this thing goes both ways, and she is not going to sit back while California threatens Arizona simply for enforcing federal law.

And if California refuses to enforce federal laws, I say take their damn funding away. They cannot have it both ways, right? Let's hear it.

It's pretty amazing, isn't it Rev? California's broke, teachers being fired, cutbacks to police and fire departments, iou vouchers instead of tax refunds...but let's keep pouring billions of dollars towards ILLEGAL immigrants.

I guarantee you that probably no one in San Francisco is aware of the California Immigration Law and, if they were to be made known, you'd see in a heartbeat a huge movement to repeal it. I guess because breaking the law is so...I don't know...progressive?

I don't know why Gavin Newsom isn't facing charges of breaking federal law. Or Arnie. Or every mayor of every city that is a "sanctuary" city and every governor of every state that does not enforce federal law.

How stupid of L.A. to say they're going to "cancel business contracts". Yeah, that's the way. The state is bankrupt so let's get rid of tax-paying businesses.

And I'm SO tired of these idiots talking about violation of human rights. How about violation of laws? We are a country of laws. If you don't respect this country enough to abide by the laws, stay away. And, as a country of laws, if you break the law you pay the price.

I just called Governor Brewer's office and told them I supported the law and was going to try to find a way to come to AZ for a weekend and spend my money there.

This is just so completely stupid, it's beyond comprehension.

I cannot WAIT to get out of here and move to Montserrat. Hey, maybe if I rob a liquor store, and tell the authorities I did it because I couldn't earn enough money legally, they'd let me slide? I do live in a sanctuary city, after all.....

Hey, SF -

it really is absurd, isn't it?? Our elected officials deciding to thumb their noses at enforcing Federal and state laws? It is mind boggling that none of them are being brought up on charges by CA itself.

Didn't you just LOVE the response from San Diego? "Ah, c'mon, AZ, we don't really MEAN it, don't take your business away even though we are taking business away from YOU." Are they out of their freakin' MINDS??

No kidding abt the money. Ahnold says no more welfare for American citizens, but it's A-Okay to spend billions providing services to people who cross the border illegally.

And while we're on the subject, can you BELIEVE the Deputy Sec. of State comparing AZ's "human rights abuses" to CHINA'S??? They are enforcing Federal Law - LAW - and they are being compared to CHINA? Holy SHIT, he needs to be fired NOW. Hillary better step up and denounce what he said and soon, or else her photo is coming off the front of my blog. That'll show her. :-)

Abt those contracts - I would say they are legally binding but CA doesn't seem to give a damn abt the law. So, I reckon you'll be fine if you knock over a liquor store. Right? I mean, hey - what's the big diff??

Holy crappydoo, SF. What has happened to our country?? Obama refuses to say that Daniel Pearl was killed by Islamic extremists and refuses to take questions at a FREEDOM OF THE PRESS Act ceremony. Our AG and HS Sec. have declared AZ's law a smear on our country without even READING it first (10 pages long - it is TEN pages long, 16 with notations), our debt is escalating, and we claim one of our states is worse on human rights than China. WTF???

It is mind boggling, isn't it! I'm getting a bit upset with Big Dawg Bill, and if Hillary doesn't start speaking up against this nonsense... well, then they are just too entrenched in the party to really be able to make a difference and I'll have to take my vote elsewhere.

If anyone from the Bush administration had compared AZ to China in human rights violations, you'd have had every media outlet screaming with hysteria.

So, just in the past few days, we have the Pretendident who won't answer questions at a Freedom of the Press signing, the USAG condemning a bill he hasn't read, and the Asst SoS comparing an AZ law enforcing the law to China's human rights violations.

I don't know what's happened to this country. The damage done in 1 year is scary. I don't think we can survive another 3 years and still be the same country we've been for over 200 years.

WTF indeed!

Word verification: coingot. My coin got taken from me to be redistributed to someone else.

SF, great word verification!!

You said it, on all fronts. This is what I was concerned abt with Hillary taking this job - her being pulled into these kinds of situations, and having to defend such offensive statements. This one is beyond the pale, though.

Sigh. I am just shaking my head in complete disbelief and disgust, SF. Holy moley...

Ya know, when we were making arrangements for my son to go to Sweden in the fall for his Studies Abroad in college, we went to a meeting where they discussed all the things we had to do prior to his trip. We had to get a passport, apply for a resident pass (it’s like a Visa) and make the arrangements for travel. They made it very clear, ALWAYS have a copy of your Passport and Resident Pass on you while in Sweden. In case of traveling outside of Sweden to other countries, ALWAYS carry your original Passport and Resident Pass with you. They made it clear…”You will be asked to show those papers and you must have them or be arrested.

Now, I don’t see anyone from the University boycotting countries abroad because they demand this information from those who are not citizens of their countries. But for us? We are supposed to open the flood gates to anyone who cries “racism”, even when they are here illegally.

We are doing all that is required in order to have my son visit another country, and we aren’t the least bit upset about it or feel that my son is being “violated” by their government.

Rabble Rouser Reverend Amy said...

Yay, Mary Ellen!! I have been thinking of you SO much. I almost wrote you yesterday, but didn't want to bug you...Anyway, so very nice to *see* you again!

What, you mean you are not going to demand that the Civil Rights Division of Sweden work around the clock to see if their demands of citizenship status are human rights violations?? Don't you love your son?? ( I so couldn't resist that one...)

That is it in a nutshell, ME - no other country in the WORLD allows people to come and go willy nilly without proper documentation. We have ol' Calderon visiting today, no doubt trashing this enforcement of federal law when Mexicao is far, far stricter abt this, and far harsher to those caught violating their laws.

And did you hear that SF is looking into allowing illegal aliens to be able to VOTE?? I am not making this up. Hell, even Puerto Ricans cannot vote in our national elections, and San Francisco wants to let people who STOLE THEIR WAY into this country the vote? If there is any doubt whatsoever that this is all political, this should take care of that suspicion. (http://www.sfgate.com/cgi-bin/blogs/cityinsider/detail?entry_id=63778&tsp=1)

I can't help but wonder if the stupidity of those who think that illegal aliens should be allowed to vote comes from very poor education regarding the history of our country and the Constitution. I can't tell you the crap that is being taught to my son at his University! Honestly, I do believe that Kool-Aid is served with every meal in the cafeteria...with free refills. It's scary. :-(

(word verification: efentan---yup, I need one of those before I don my swimsuit this summer, I'm white as a ghost.)

Rabble Rouser Reverend Amy said...

ROTFL abt "efentan" - that's one thing abt living in the South. I don't even have to try to get a tan. Just mowing the yard is enough!

That's just it, ME - how can they treat the Constitution as if it didn't even exist, or worse, as if it is worthless?? These people are ELECTED, and presumably, as I said, swore an oath. Apparently, it was absolutely meaningless to them.

That is truly sad abt your son and his university. I imagine y'all aren't spending your hard earned dollars for his head to be filled with kool aide infused hare-brained ideas! :-) Pitiful.
